How do I file for bankruptcy and how does the process unfold?

Most people who file for bankruptcy have little understanding of how the Washington State bankruptcy process unfolds. Many of the clients we represent were unaware that they have legal rights in regards to their finances. Debt collectors and creditors do not want you to talk to one of our King County bankruptcy lawyers because they know what almost always happens next. They may threaten you and say all sorts of things that aren’t true to keep you from filing for bankruptcy. Why do you think that is?

If you’re curious about what to expect from the bankruptcy process, consider the following:

Chapter 7 and Chapter 13 Washington State bankruptcy qualification and filing process.

Step 1 – Contact a Bellevue bankruptcy lawyer.

In many facets of life, taking the first step is often the most difficult. This is especially true with bankruptcy because many people are embarrassed about being in debt or afraid of their creditors. Our Bellevue bankruptcy lawyers make this step as easy as possible by offering a free consultation to learn more about King County debt relief.

During your initial consultation, one of our bankruptcy attorneys will help you determine whether or not you can qualify for Chapter 7 or Chapter 13 bankruptcy protection. We can talk over the phone or meet in person, whatever works best for you. Bankruptcy law was created to protect you and give you a fresh start, and if your creditors tell you anything contrary, they are not telling you the truth.

It will be helpful if you prepare for your consultation. Have all of your financial information ready to share, including income, outstanding bills, lawsuits, taxes, and foreclosure papers. We will analyze your finances and figure out whether bankruptcy will work for you. In some cases, bankruptcy is not the best option, and we will tell you if this is the case.

Step 2 – Making the decision to file for bankruptcy.

Once you understand all of the facts, you can then decide whether you would like to file. If so, your King County bankruptcy attorney will immediately begin working on your case. At this point you can forward calls from creditors and collection agencies to our office and they will no longer be able to contact you in any way. If they do, simply let your lawyer know and they make them stop.

Step 3 – Follow up meetings with your lawyer.

Bankruptcy cases in Washington State are usually straightforward, but you will need to visit our office on occasion to go over details or sign papers. We will have the documents ready so that we can quickly review them, and then we can answer any questions you may have.

Step 4 – Signing all paperwork.

When the last of the paperwork is prepared, you simply have to sign. Then, we take that paperwork to the Washington Bankruptcy Court.

Step 5 – Filing your bankruptcy case.

If you live in Bellevue, WA your case will be handled by the US District Court in Western Washington. This is when the automatic stay goes into effect, so if creditors contact you at all from this point forward they can be liable for attorney’s fees and punitive damages. They can’t call you, send you any letters, or attempt to garnish your wages. Filing for bankruptcy also puts a stop to foreclosures, vehicle repossessions, and even the IRS.

Step 6 – Meeting with creditors.

Around 30 to 45 days after filing, you will have to attend a Meeting of Creditors. This sounds worse than it really is and your Washington bankruptcy lawyer will be at your side the entire time. Your attorney will also ensure that you are fully prepared to answer any and all questions.

Step 7 – Discharge of debt.

If you file for Chapter 7 bankruptcy, your dept will be discharged about 3 months after your meeting with creditors. If you file Chapter 13, the trustee in the bankruptcy case informs you of what needs to be done to finalize your payment plan. If you make your monthly payments for the 3 to 5-year duration of the plan, your remaining debt is then fully discharged.

Step 8 – A new financial beginning.

That’s it. The process is done and you can start rebuilding your credit. This happens faster than most people realize. If any of your previous creditors try to contact you at all, simply call your Bellevue bankruptcy lawyer and they will set them straight.
